Your Future is Our Priority
Part of responsible estate planning is ensuring someone can express your wishes and handle your finances if you are not able to do so yourself. At the Dedham, Massachusetts, law firm of Samuel, Sayward & Baler LLC, we assist clients to legally appoint people who will manage financial and legal matters. We also draft health care proxies, which allow you to designate the person who will carry out your wishes regarding your health care.
To schedule an appointment with a Massachusetts estate planning lawyer on topics such as the importance of creating a power of attorney, contact us at Samuel, Sayward & Baler LLC.
Power of Attorney
Appointing someone as your attorney-in-fact in your durable power of attorney allows that person to access your financial documents and other necessary documents needed to file taxes and retrieve insurance information on your behalf, as well as to act on your behalf to handle all types of financial matters. A power of attorney created as part of a comprehensive estate plan must be a durable power of attorney. A durable power of attorney is one that remains in effect even if you become incapacitated.
Health Care Proxy
Creating a health care proxy is extremely important. This document appoints a health care agent to make health care decisions for you if you cannot do so for yourself. As when appointing an attorney-in-fact, your health care agent should be someone you trust to carry out your wishes.
Health care proxies are state specific. As a result, Massachusetts may not recognize a health care proxy signed in another state. At Samuel, Sayward & Baler LLC, we will explain how this document works and will guide you through the process of appointing your health care agent. We also assist clients in updating their health care proxies.
